IMPORTANT DISCLAIMER - PROPERTY INVESTMENT CALCULATIONS, FORECASTS AND PROJECTIONS
Please read this disclaimer carefully before relying on any information, calculation, estimate, forecast or projection provided by Equiti Ltd.
1. General information only - not personalised financial advice
The information, calculations, tools, illustrations, forecasts and projections provided by Equiti Limited (“Equiti”), whether through its website, investment calculators, spreadsheets, reports, presentations, webinars, emails, coaching sessions or other materials, are provided for general information and educational purposes only.
They are not intended to constitute, and must not be relied upon as, personalised financial advice, investment advice, legal advice, tax advice, accounting advice, lending advice or a recommendation to acquire, hold, finance or dispose of any particular property or other asset.
The information has not necessarily been prepared with regard to your individual financial circumstances, objectives, investment experience, risk tolerance, income, liabilities, tax position or future needs. You should assess any investment opportunity independently and obtain appropriate professional advice before making an investment decision.
2. Estimates, assumptions and illustrative projections
All figures, calculations, estimates, scenarios, forecasts and projections are indicative only and are based on information available to Equiti at the time of preparation, together with assumptions, inputs, estimates or data supplied by you or obtained from third parties.
These may include, without limitation:
-
Property purchase prices, current market values and future capital growth.
-
Rental income, rental increases, vacancy rates, occupancy and tenancy assumptions.
-
Mortgage interest rates, loan amounts, loan structures, lending availability and repayment schedules.
-
Deposit requirements, borrowing capacity, lending criteria and refinancing assumptions.
-
Operating expenses, property management fees, insurance, rates, maintenance and other ownership costs.
-
Tax treatment, deductible expenses, interest deductibility and other tax-related assumptions.
-
Inflation, wage growth, income growth and changes in the cost of living.
-
Sale prices, selling costs, transaction costs and the timing of a future sale.
-
Cash flow, equity accumulation, return on investment, net worth, retirement shortfalls and projected wealth.
-
Future property market conditions, economic conditions, population growth, infrastructure development and other market-related factors.
The results are dependent on the assumptions and inputs used. Different assumptions, revised information or changes in circumstances may produce materially different results. Calculations may also be affected by rounding, data limitations, errors in source information or limitations in the calculation methodology.
Projections are not guarantees, promises or predictions of actual future performance. They are illustrations of possible outcomes under specified assumptions and should not be interpreted as the most likely outcome or as an assurance that a particular financial result will be achieved.
3. Property values and capital growth
Property markets are subject to fluctuations and uncertainty. Actual property values may increase, remain unchanged or decrease. Past performance, recent valuation movements, historical market data, comparable sales and projected growth rates are not reliable guarantees of future performance.
Any projected capital growth rate, estimated future property value, equity position or potential capital gain is hypothetical unless expressly identified otherwise. Actual market values may differ materially from projections and may be affected by factors including interest rates, supply and demand, economic conditions, local market conditions, construction quality, location, infrastructure, government policy and other unforeseen events.
Any reference to an increase in a property's value, including a valuation, estimate or reported market movement, does not necessarily represent a realised profit. A gain is generally not realised until the property is sold, and the net amount received may be reduced by debt, selling costs, transaction costs, tax liabilities and other expenses.
Equiti does not guarantee that a property will appreciate in value, outperform other investments or achieve any specified capital gain or return.
4. Rental income, expenses and cash flow
Rental income and cash-flow calculations are estimates only. Actual rental income may be lower than anticipated, rental increases may not occur as projected, and properties may experience vacancies, arrears, tenant changes, damage, unexpected maintenance, higher operating costs or other unforeseen expenses.
Interest rates may increase, lending terms may change, and a lender may decline an application, refinancing request or loan extension. Actual mortgage repayments, borrowing costs and cash-flow outcomes may therefore differ from those illustrated.
Any projected positive cash flow, rental surplus, passive income or ability to meet mortgage repayments is not guaranteed. You should independently assess whether you can afford the investment under less favourable scenarios, including higher interest rates, lower rental income, extended vacancy periods and unexpected expenses.
5. Retirement, wealth and long-term financial projections
Any retirement shortfall assessment, wealth forecast, equity projection, financial independence calculation or long-term investment scenario is an illustrative planning tool only.
Projected outcomes depend on assumptions regarding property values, rents, debt repayment, interest rates, inflation, taxation, holding periods, future purchases and sales, and other variables that may change over time.
Such calculations do not guarantee that you will achieve a particular level of wealth, income, retirement funding or financial independence. Actual outcomes may be materially different from those shown.
You should not make decisions about retirement, employment, borrowing, savings, investment diversification or other significant financial commitments solely on the basis of a projection provided by Equiti.
6. Third-party information and data
Equiti may use information obtained from developers, vendors, valuers, property managers, lenders, government agencies, market data providers, public records and other third parties.
Although Equiti may take reasonable steps to assess the information it uses, Equiti does not warrant that all third-party information is accurate, complete, current or independently verified, unless expressly stated otherwise.
Market information, estimated valuations, rental assessments, development information and other third-party data may change or contain errors. You should independently verify information that is material to your investment decision.
7. No guarantee of lending or finance
Any illustration of a deposit, loan amount, interest rate, borrowing capacity, loan-to-value ratio, debt servicing requirement or potential lending structure is indicative only.
Actual lending approval and terms are determined by the relevant lender and may depend on its policies, credit assessment, affordability requirements, valuation requirements, regulatory obligations and your individual circumstances.
Equiti does not guarantee that finance will be available, that any particular lending structure will be approved, or that a lender will offer the interest rate, deposit requirement, loan term or repayment arrangement used in a projection.
You should obtain independent confirmation from an appropriately qualified mortgage adviser or lender before committing to a purchase.
8. Tax, legal and regulatory matters
Tax laws, regulations, lending requirements and other legal obligations may change and may apply differently depending on your individual circumstances and the nature of the transaction.
Any tax-related calculations or commentary are illustrative and do not constitute tax advice. Equiti does not guarantee any particular tax deduction, tax treatment, refund, tax saving or other tax outcome.
You should obtain advice from a suitably qualified accountant or tax adviser, together with independent legal advice from a qualified New Zealand lawyer, before entering into a property transaction.
9. No reliance on projections as the sole basis for a decision
You acknowledge that property investment involves financial risk, including the potential loss of capital, reduced property values, negative cash flow, increased borrowing costs, unexpected expenses and difficulty selling a property when required.
You are responsible for independently evaluating any investment opportunity, checking the accuracy of relevant information, assessing the assumptions used and determining whether the investment is appropriate for your own circumstances.
You should consider alternative scenarios, including less favourable outcomes, and obtain independent professional advice where appropriate. You should not rely on any single calculation, forecast, projected return, estimated valuation or other illustrative result as the sole basis for an investment decision.
10. Limitation of liability
To the maximum extent permitted by applicable New Zealand law, Equiti excludes liability for any loss, damage, cost or expense arising from or in connection with the use of, reliance upon, or inability to use any calculations, estimates, forecasts, projections, assumptions, third-party information or other materials covered by this disclaimer.
This includes, to the extent legally permitted, direct, indirect, incidental or consequential loss, loss of anticipated profits, loss of opportunity, unexpected costs and financial losses resulting from changes in market conditions or actual outcomes differing from projected outcomes.
Nothing in this disclaimer excludes, restricts or modifies any right, remedy, guarantee, obligation or liability that cannot lawfully be excluded, restricted or modified under applicable law. Nothing in this disclaimer limits liability to the extent that such limitation is prohibited by law.
11. Updates and changes
Information, assumptions, calculations, forecasts and projections are based on the data and circumstances applicable at the time they are prepared. They may become outdated or inaccurate as circumstances change.
Equiti is not obliged to update any information, calculation, forecast or projection unless expressly agreed or required by law. You should independently verify the current position before relying on information previously provided.
